Lawful bases and data protection rights

Under UK data protection law, we must have a “lawful basis” for collecting and using your personal information. There is a list of possible lawful bases in the UK GDPR. You can find out more about lawful bases on the ICO’s website.

Which lawful basis we rely on may affect your data protection rights which are set out in brief below. You can find out more about your data protection rights and the exemptions which may apply on the ICO’s website:

If you make a request, we must respond to you without undue delay and in any event within one month.

To make a data protection rights request, please contact us using the contact details at the top of this privacy notice.

Our lawful bases for the collection and use of your data

Our lawful bases for collecting or using personal information to provide and improve products and services for clients are:

  • Legitimate interests – we’re collecting or using your information because it benefits you, our organisation or someone else, without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability. Our legitimate interests are:

    • We ask for your feedback so we can learn what worked and what didn’t, improve the services we give you and other clients, and show the difference our work makes. We ask for your name, job title and organisation so we can link your feedback to the right programme and follow up with you on anything you raise, such as a concern about our work. Most questions about outcomes are optional, and you can leave out anything you consider commercially sensitive. We have weighed this against the impact on you. You are a business contact giving feedback on work we did together, so you would reasonably expect us to ask. The risk to you is low: your answers are seen only by the e50K team, kept for 3 years after your programme ends, and never published without your consent. You can object at any time by contacting us, and we will stop using your information for this purpose.

For more information on our use of legitimate interests as a lawful basis you can contact us using the contact details set out above.

Our lawful bases for collecting or using personal information for information updates or marketing purposes are:

  • Consent - we have permission from you after we gave you all the relevant information. All of your data protection rights may apply, except the right to object. To be clear, you do have the right to withdraw your consent at any time.

We will not publish anything until the approver you name has agreed the final wording.

  • Legitimate interests – we’re collecting or using your information because it benefits you, our organisation or someone else, without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability. Our legitimate interests are:

    • If you ask us to send the wording of a quote or case study to a colleague for approval, we use their name and email address only to contact them about that approval. This protects them and your organisation by making sure nothing is published without the right person’s agreement. We have weighed this against the impact on your colleague. They are a business contact being asked to review wording on behalf of their organisation, so they would reasonably expect to be contacted. The risk to them is low: we use their details for nothing else, we tell them how we got their details when we first contact them, and we delete their details once the wording is approved. They can object at any time by contacting us.

For more information on our use of legitimate interests as a lawful basis you can contact us using the contact details set out above.

Where we get personal information from

  • Directly from you

  • From a colleague at your organisation, if they name you in our client feedback survey as the person to approve wording before we publish it.

How long we keep information

We keep your survey answers for 3 years after your programme ends. If you give us a colleague’s details to approve published wording, we delete them once the wording is approved. If you agree to us publishing a quote or case study, we keep it and the record of your agreement for as long as we use it, and for 1 year after we stop. After these periods we delete your information, or remove anything that identifies you so it can only be used for overall statistics.

Who we share information with

Data processors

This data processor does the following activities for us: Microsoft provides the online tools we use to run our client feedback survey. Microsoft only uses the data to provide these services to us and does not use it for advertising or profiling.
